Terms and Conditions

Words with an initial capital letter have meanings defined under the following conditions, whether they appear in singular or in plural. For the purposes of these Terms and Conditions:

• Company(referred to as "the Company", "We", "Us" or "Our") refers to TextPulse AI, 430 Park Avenue, New York, NY 10022, United States.
• Service refers to the TextPulse.ai website and web application, including the AI text humanizer and related features.
• Terms and Conditions(also "Terms") mean these Terms and Conditions, which form the entire agreement between You and the Company regarding the use of the Service.
• Device means any device that can access the Service, such as a computer, a cellphone or a digital tablet.
• You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.
• Country refers to: New York, United States.

These Terms and Conditions govern the use of this Service and form the agreement that operates between You and the Company. They set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.

You represent that You are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with Our Privacy Policy, which describes Our policies on the collection, use and disclosure of Your personal information. Please read it carefully before using the Service.

To access the Service You must create an account with accurate, current and complete information, and keep it up to date. You are responsible for safeguarding Your password and for all activity under Your account. Notify Us immediately if You suspect unauthorized access.

By creating an account, You agree to receive approximately 1 to 2 emails per month from TextPulse covering product updates, new features, occasional promotional offers, and important service notices. You can unsubscribe at any time using the link at the bottom of any marketing email, or by contacting [email protected].

You may delete Your account at any time from the Settings page of the app. Your personal information, humanization history, and account metadata are automatically deleted from Our active systems as part of Our GDPR compliance. Free plan and paid subscriptions

Every account begins on Our Free plan, which includes a demonstration of the humanizer so You can evaluate the Service before paying anything. Paid subscriptions (Pro and Plus, billed monthly or annually through Stripe) are selected and purchased manually by You at checkout, including the plan and the billing cycle. Because You choose and confirm Your plan Yourself, a paid subscription is never started automatically or by mistake.

Plan features and limits

Each plan includes the features and usage limits described on Our pricing page at the time of purchase, including monthly word allowances and per-pass word caps. The Free plan includes a limited demonstration so You can evaluate the core Service before paying; humanizing Your own text and certain features (including, for example, intensity levels, all writing modes, multilingual humanization, and freeze terms) are available only on paid plans, and some only on specific paid plans. We may add, modify, or remove features from any plan, and adjust usage limits, at any time. Where a change materially reduces the features of a paid plan You are actively subscribed to, We will notify You before it takes effect.

One-time credit packs add words to Your account balance. Credit pack words never expire and are consumed after Your monthly allowance. Credit packs are available on paid plans only.

Automatic renewal

If You subscribe to a paid plan, that subscription renews automatically at the end of each billing period for another period of the same length, at Our then-current fees for that plan, unless You cancel before the renewal date. You authorize Us and Our payment processor to charge Your payment method on each renewal until You cancel.

No refunds

Subscriptions and credit packs are non-refundable. All payments made under these Terms are non-refundable and payment obligations are non-cancelable. We do not provide refunds or credits for any partially used subscription period, for unused words or credits, for plan downgrades, or for change of mind.

The only exception: We may, at Our sole discretion, issue a refund where BOTH of the following are true at the time You request it: (a) the request is made within 24 hours of the payment, and (b) fewer than 1,000 words have been processed on Your account since that payment. Our account records of words processed are decisive for condition (b). Requests made after the first 24 hours of a payment, or after 1,000 or more words have been processed, or for any other reason, are not eligible for a refund.

Cancelling Your subscription

You can cancel Your subscription Yourself at any time from the Billing page of the app: sign in, open Billing, choose Manage subscription, and confirm the cancellation. Cancellation stops all future charges. You keep full Pro or Plus access until the end of the billing period You have already paid for, after which Your account automatically converts to the Free plan. No further payment is taken once You have cancelled.

Billing records and disputes

To operate the Service and to resolve any billing dispute, We keep records of account activity, including the words processed and credits used on Your account. Where a payment dispute or chargeback is filed, We may rely on these records, together with Your acceptance of these Terms at signup and at checkout, as evidence that the Service was purchased and used.

Price changes

We reserve the right to change pricing with 30 days' notice. Price changes do not affect Your current billing period.

Mandatory local consumer rights

Some countries and regions have mandatory consumer-protection laws regarding cancellation and refund rights. Nothing in this section overrides any rights You have under those mandatory laws where they apply to You.

You agree not to:

• Use the Service to violate any applicable law or regulation
• Submit content that infringes on the intellectual property rights of others
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Use automated systems (bots, scrapers) to access the Service without written permission
• Resell, redistribute, or sublicense access to the Service
• Interfere with or disrupt the Service or its infrastructure
• Submit malicious content including malware, viruses, or harmful code

Our position on the responsible use of AI in academic work, including disclosure and citation of AI assistance, is set out in Our AI Use Policy.

You retain full ownership of all text You submit to the Service ("User Content"). By submitting text, You grant TextPulse a limited, non-exclusive license to process Your content solely for the purpose of providing the Service. We do not claim ownership of Your content and do not use it to train AI models.

The Service, including its design, code, features, and branding, is owned by TextPulse and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant You any rights to use TextPulse trademarks, logos, or branding without prior written consent.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or factors beyond Our control.

Third-party AI detection tools produce probabilistic assessments that change as their algorithms are updated. TextPulse does not guarantee specific scores from any third-party AI detector or that any particular output will achieve a particular result. Results vary with the input text, the settings used, and the detector doing the scoring.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services, and shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services. We strongly advise You to read the terms and privacy policies of any third-party websites You visit.

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms. Upon termination, Your right to use the Service ceases immediately. You may delete Your account at any time from the Settings page. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) continue to apply.

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms, and Your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by You through the Service or 100 USD if You have not purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, or loss of privacy) arising out of or in any way related to the use of or inability to use the Service, even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. The Company provides no warranty that the Service will meet Your requirements, achieve any intended results, be compatible with any other software or services, operate without interruption, or be error-free.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. In such a case, the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

You agree to indemnify and hold harmless TextPulse from any claims, damages, or expenses arising from Your use of the Service, Your User Content, or Your violation of these Terms.

The laws of the Country, excluding its conflicts of law rules, govern these Terms and Your use of the Service. Your use of the Service may also be subject to other local, state, national, or international laws.

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.

You represent and warrant that (i) You are not located in a country that is subject to a United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Service.

TextPulse complies with the EU General Data Protection Regulation (GDPR).
